Bite and Bloom Botanicals LLC ("we," "us," "our," or "Company") operates the website biteandbloombotanicals.com (the "Site"). These Terms and Conditions ("Terms") govern your access to and use of the Site, as well as any purchases of products from us. We are an online retailer specializing in live plants and botanicals, registered as an LLC in Oregon, and we ship products nationwide across the United States (excluding certain restricted areas as noted below).

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.

We reserve the right to update these Terms at any time. Changes will be effective upon posting the revised Terms on the Site, with an updated "Effective Date." Your continued use of the Site after changes constitutes acceptance of the revised Terms.

1. Use of the Site

You agree to use the

Site only for lawful purposes and in accordance with these Terms. You must be at least 18 years old or have parental consent to make purchases.

Prohibited activities include:

Violating any laws or regulations.
Interfering with the Site's functionality.
Attempting to gain unauthorized access.
Submitting false information.

2. Products and Orders

We sell live plants and related botanicals ("Products"). Product descriptions, images, and prices are subject to change without notice. We strive for accuracy but do not guarantee that descriptions or images are error-free.

All orders are subject to acceptance and availability. We may cancel or refuse any order for any reason, including pricing errors or suspected fraud.

Prices are in USD and exclude shipping, taxes, and fees, which will be calculated at checkout.

3. Shipping and Delivery

We ship Products nationwide within the contiguous United States, subject to restrictions. Due to U.S. Department of Agriculture (USDA) regulations and state laws designed to prevent the spread of pests and diseases, we do not ship to certain states or regions (e.g., California for some plants, Hawaii, Alaska, or areas under quarantine). You are responsible for verifying that your shipping address allows receipt of the ordered Products. We reserve the right to cancel orders to restricted areas.

Products are live goods and perishable. We package them carefully for transit, but delivery times and conditions may affect plant health. Risk of loss passes to you upon delivery to the carrier.

Estimated delivery times are provided but not guaranteed. We are not liable for delays due to carriers, weather, or other events beyond our control.

4. Live Arrival Guarantee and Returns

Live plants are guaranteed to arrive alive and in good condition. If a plant arrives damaged or dead due to shipping:

Contact us within 6 hours of delivery with photos.
We will, at our discretion, issue a replacement, store credit, or refund for the affected plant(s).

Beyond live arrival, we do not guarantee plant survival, as it depends on your care, environment, and conditions after delivery.

Returns and Refunds:

Live plants are generally non-returnable and non-refundable except for shipping damage as noted above.
Refunds (if approved) will be issued to the original payment method, minus any shipping costs.
We do not accept returns for buyer's remorse.

Products may be final sale.

5. Payments

We accept major credit cards and other methods displayed at checkout. Payment is due at the time of order. You authorize us to charge your provided payment method.

6. Intellectual Property

All content on the Site (text, images, logos, etc.) is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not use it without our written permission, except for personal, non-commercial use.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or Products.

Our total liability for any claim related to an order shall not exceed the amount paid for that order.

Products are sold "as is" with no warranties beyond the live arrival guarantee. We disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Live plants are natural and may vary in appearance, size, or health.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or misuse of the Site/Products.

9. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of laws principles.

Any disputes shall be resolved in the state or federal courts located in Oregon. You consent to personal jurisdiction in those courts.

We encourage informal resolution first—contact us to discuss any issues.

10. Force Majeure

We are not liable for failures due to events beyond our control (e.g., natural disasters, pandemics, carrier issues).

11. Miscellaneous

These Terms constitute the entire agreement between you and us.

If any provision is invalid, the remainder remains in effect.

No waiver of any term shall be deemed a continuing waiver.
