Refund Policy

Effective Date: January 6, 2026

Bite and Bloom Botanicals LLC ("we," "us," "our," or "Company") is an online retailer specializing in live plants, tissue culture plants, tissue culture media kits, and related botanicals, registered as an LLC in Oregon, with shipping available nationwide across the United States (subject to applicable restrictions). This Return and Refund Policy ("Policy") outlines the terms under which returns, refunds, or replacements may be available for products purchased through our website biteandbloombotanicals.com (the "Site"). This Policy is incorporated into and forms part of our Terms and Conditions. By making a purchase, you agree to be bound by this Policy.

All sales are final except as expressly provided in this Policy. We do not accept returns or issue refunds for buyer's remorse, failure to read product listings or descriptions, or any other circumstances beyond our control, including but not limited to USPS or other carrier transit delays, misdeliveries, or weather-related issues not covered under our guarantees.

We reserve the right to update this Policy at any time. Changes will be effective upon posting the revised Policy on the Site, with an updated "Effective Date." Your continued purchases after changes constitute acceptance of the revised Policy.

1. Live Arrival Guarantee for Live Plants

We offer a limited Live Arrival Guarantee for live plant orders, subject to the conditions below. This guarantee applies only to plants that arrive dead on arrival ("DOA") and does not cover shocked, wilting, or otherwise stressed plants, as some minor damage or adjustment during shipping is normal and expected for live goods.

  • Notification Requirement: You must notify us of any DOA issues within 6 hours of delivery notification (e.g., via email or tracking update confirming delivery). Notification must include clear photos or video proof of the DOA condition, taken immediately upon unboxing, showing the plant(s) in their original packaging.

  • Cold Weather Orders: If you are ordering live plants during cold temperatures (below 40°F at any point in transit, based on weather forecasts for your shipping route), you are responsible for purchasing a heat pack and insulation from our shop to include with your order. Failure to do so voids the Live Arrival Guarantee, and no refund or replacement will be provided for cold-related damage.

  • Resolution: If your claim meets all requirements, we will, at our sole discretion, issue a replacement plant (if available), store credit, or partial refund for the affected item(s) only. Shipping costs are non-refundable.

  • Exclusions: The guarantee does not apply to any damage or issues arising after delivery, including improper care, environmental factors, or delays beyond our control. Shocked or wilting leaves do not qualify as DOA.

2. Policy for Tissue Culture Media Kits and Tissue Culture Plants

Tissue culture media kits and tissue culture plants are specialized, perishable items, and returns or refunds are strictly limited.

  • Damage Claims: Refunds will not be issued for tissue culture media kits without video proof of damage provided within 24 hours of delivery notification. Video must clearly show the damage upon unboxing, in original packaging. Some media displacement in tissue culture kits and tissue culture plants is normal and does not qualify for a refund.

  • DOA for Tissue Culture Plants: For tissue culture plants claimed as DOA, you must follow the same 6-hour notification requirement as for live plants, including video proof.

  • Resolution: Valid claims may result in a replacement, store credit, or partial refund at our discretion. Shipping costs are non-refundable.

3. General Return and Refund Guidelines

  • All Sales Final: Except for valid claims under the Live Arrival Guarantee or damage to tissue culture items as described above, all sales are final. No returns or refunds will be accepted for any reason, including but not limited to:

    • Buyer's remorse or change of mind.

    • Failure to read product listings, care instructions, or shipping restrictions.

    • Transit delays, misdeliveries, or losses caused by carriers (e.g., USPS).

    • Any events or conditions outside our control, such as weather, pests, or post-delivery care.

  • Non-Plant Items: For non-perishable accessories or supplies (if offered), returns may be accepted within 30 days if unused, in original packaging, and with proof of purchase. Contact us for approval. Refunds will be issued minus shipping costs.

  • Refund Process: Approved refunds will be issued to the original payment method within 7-10 business days of approval. We do not refund original shipping fees or return shipping costs.

  • Inspection Rights: We reserve the right to inspect any returned items (if applicable) and deny claims if evidence suggests misuse, tampering, or non-compliance with this Policy.

4. How to Submit a Claim

To submit a claim under this Policy:

  • Contact us at bitebloombotanicals@gmail.com within the specified timeframes.

  • Provide your order number, detailed description of the issue, and required photos/video proof.

  • We will review and respond within 48-72 hours.

5. Limitation of Liability

To the fullest extent permitted by law, our liability under this Policy is limited to the purchase price of the affected product(s). We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.

6. Governing Law

This Policy is governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from this Policy shall be resolved in accordance with the dispute resolution provisions in our Terms and Conditions.
